These Terms of Use ("Terms") govern your use of the Yumeship mobile application ("Yumeship" or the "App"), operated by Worldbuilders Inc. ("we", "our", "us"). By using the App, you agree to these Terms.

Section 18 requires most U.S. disputes to be resolved through individual arbitration and includes class-action and jury-trial waivers. You may opt out of arbitration within 30 days.

1. Eligibility

You must be at least 13 years old to use Yumeship. If you are 13 to 17, you may use the App only if a parent or guardian has reviewed and agreed to these Terms and given you permission to use the App.

We do not knowingly allow children under 13 to use the App. If we learn that a user is under 13, we may delete their data and prevent further use.

If you use Yumeship for an organization or other legal entity, you represent that you can bind it to these Terms. That entity is legally and financially responsible for use of its account by its employees, agents, and contractors.

You may not sell, transfer, or share an account or use another account to evade a restriction. We may change or reclaim a username or identifier that violates another person’s rights, misleads users, or is reasonably needed for service operations.

2. What Yumeship Is

Yumeship is a private-first creative tool for fictional relationship artifacts. It may also offer optional sharing, social, backup, notification, customization, and paid features, including Picshare, Moots, Shippers, and paid feed placements.

Yumeship is not therapy, crisis support, dating, direct messaging, real-person rating, or a tool for impersonating real people. Features vary by version and platform.

3. Your Content and the Permission You Give Us

You keep any ownership rights you have in content you create or submit through Yumeship ("Your Content").

You are responsible for Your Content. You represent and warrant that it complies with law and our policies; that you have every right, consent, release, and permission needed to submit it and grant these licenses, including from people depicted or recorded and their guardian where required; and that testimonials reflect your honest experience and opinion.

For private or local content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to process it only as needed to provide, secure, support, or improve the features you request. Private ship documents, local scrapbook content, and private backups may not be used to advertise Yumeship or train AI. Optional account backup uses private access-controlled storage, is not public sharing or real-time sync, and does not use a custom client-side content-encryption layer.

Content you intentionally publish through Picshare, Moots, Shippers, or another sharing or social feature ("Social Content") is non-confidential. Social Content includes content that Yumeship makes available through KinChat or another connected service at your direction. You grant Worldbuilders Inc. and its parents, affiliates, successors, assigns, providers, contractors, agencies, business partners, and distributors a worldwide, perpetual, irrevocable, non-exclusive, fully paid, royalty-free, transferable, sublicensable, through-to-the-audience license to host, store, use, reproduce, edit, crop, resize, excerpt, modify, adapt, translate, caption, remove metadata from, create derivative works from, combine, transmit, publish, syndicate, display, perform, distribute, broadcast, rank, moderate, analyze, secure, monetize, commercialize, advertise, promote, and otherwise process Social Content in any current or future media.

For users who accept Terms containing these permissions, the permissions cover Social Content and public social activity that remain associated with the account as well as content and activity published later. If you do not want the expanded permissions to cover existing Social Content, do not accept these Terms; use the available account-deletion process or contact us to request deletion.

We may use that license to operate, improve, develop, research, explain, advertise, promote, and create commercial products and services for Yumeship and related services; create paid or unpaid ads, app-store materials, press materials, datasets, research materials, and product demonstrations, subject to the model-training restrictions below. We may use or omit submitted names, profiles, handles, avatars, captions, voices, likenesses, and attribution without further notice, inspection, approval, attribution, or compensation. You waive related moral, publicity, privacy, and attribution rights to the fullest extent permitted by law. We will obtain any separate consent that applicable law requires, including for certain uses of a minor's likeness.

Subject to applicable law, we may in the future use text you intentionally share publicly through Yumeship for AI model training, after providing notice describing the use and obtaining any legally required consent. Notwithstanding any other content license in these Terms, neither we nor third parties we authorize may use artwork, uploaded media, text extracted from that media, or private content for model training or training datasets. We may use automated tools to review shared content for safety and enforce our policies.

To the extent public votes, reactions, follows, memberships, engagement, and other public social activity are not part of Your Content or protected by intellectual-property law, you authorize us to collect, combine, analyze, derive information from, and use that public activity and related metadata for the same purposes, subject to our Privacy Policy and applicable law.

We may monetize authorized uses without sharing revenue or value with you unless we separately agree in writing. Distribution intermediaries owe no separate compensation or liability solely for an authorized use. Other users receive only the limited license needed to use Social Content through features Yumeship enables; they receive no independent off-platform rights.

The private-content license ends after active deletion, subject to backups and records we may lawfully retain. The Social Content license survives deletion and termination to the fullest extent permitted by law. Deletion does not require us or our partners to recall, undo, or destroy existing or committed campaigns, distributed copies, moderation or legal records, or non-identifying models and improvements lawfully created under the model-training permissions and restrictions above.

A connected service's separate terms may also apply to Social Content it stores. Content you only view from a connected service is not relicensed by you.

We may reject, label, limit, remove, or stop distributing content and have no duty to publish, preserve, recommend, or verify it. Feedback is non-confidential and licensed to us perpetually, irrevocably, worldwide, and royalty-free for any purpose. We will not treat private content or account information as feedback. You are responsible for exports and outside sharing.

4. App License

We grant you a personal, limited, non-transferable, revocable license to use Yumeship for its intended creative features, subject to these Terms and any App Store or Google Play terms that apply to your download.

You may not copy, sell, rent, sublicense, reverse engineer, interfere with, or misuse the App except where the law gives you a right that cannot be limited by these Terms.

Unless we authorize it in writing, you may not scrape, crawl, index, archive, data-mine, use automated means to access or extract data from, probe, test, bypass, or circumvent the App; use the App or its content to build, train, test, or improve a competing product, dataset, model, or service; or remove or alter ownership, attribution, safety, or rights-management information.

You may not use Yumeship in violation of applicable import, export-control, embargo, or sanctions laws or while listed on a government prohibited- or restricted-parties list.

Worldbuilders Inc. and its licensors retain all right, title, and interest in and to the App, its software, services, designs, branding, placement systems, and other materials, excluding your content and third-party material. All rights not expressly granted to you in these Terms are reserved.

These Terms are between you and Worldbuilders Inc., not Apple or Google, and Worldbuilders Inc. is responsible for Yumeship. Your app license is non-transferable and limited to devices and usage allowed by the applicable store rules. Apple has no obligation to provide maintenance or support. If the iOS app fails to conform to an applicable warranty, you may notify Apple for any refund Apple is required to provide; Apple has no other warranty obligation to the fullest extent permitted by law.

Apple is not responsible for product-liability, legal-compliance, consumer-protection, or intellectual-property claims concerning Yumeship. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions benefiting them after your acceptance. You must comply with applicable third-party terms and represent that you are not in an embargoed region or on a U.S. government prohibited- or restricted-parties list.

5. Fan Content and Third-Party Rights

Yumeship may be used for fan-created or fictional materials. You are responsible for making sure your use of names, characters, images, artwork, trademarks, or other third-party material is lawful and allowed.

You can grant us only rights you actually control. Your submission does not give us rights owned by a character owner, artist, photographer, performer, person depicted, music owner, or other third party. We may require proof of permission, decline to use content, or remove content without assuming responsibility for clearing those rights.

Yumeship is not affiliated with, endorsed by, or sponsored by any third-party fandom, media property, character owner, publisher, studio, or rights holder unless we say otherwise.

6. Copyright Notices

If you believe content in Yumeship infringes your copyright, send a copyright notice to support@worldbuilders.app. Include your physical or electronic signature, enough information to identify the copyrighted work, enough information to identify the allegedly infringing content and where it appears, your contact information, a statement that you believe in good faith that the use is unauthorized, and a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

We may remove or disable access to allegedly infringing content, forward notices to the user who posted the content, accept appropriate counter-notices, and terminate repeat infringers where appropriate.

7. Picshare, Moots, and Shippers

Picshare and Moots sharing are optional and off by default. If enabled, Yumeship uploads the sharing-safe profile you choose. Shared links are not guaranteed confidential and may be forwarded, copied, or captured.

Shippers is a signed-in social service governed by our Community Guidelines. Content you submit there, including profiles, posts, comments, images, votes, and Chat messages, is Social Content. Yumeship does not automatically publish private ship data, but any private material you choose to post becomes Social Content.

We may use manual and automated review, providers such as Google Cloud or OpenAI, rate limits, classifiers, hash matching, and other safety tools. We may reject, label, limit, hide, preserve, or remove content; restrict features; report apparent illegal content; and suspend or permanently ban access, with or without prior notice, to enforce our policies, comply with law, protect people or the service, or address abuse, fraud, evasion, security, or operational risk. We do not guarantee a particular review time or outcome.

Social access is a limited, revocable permission, not an entitlement or guaranteed paid feature. Restrictions apply to the person and may extend to other accounts used for evasion. A social restriction does not ordinarily revoke validated private local features or Pro access, but severe abuse may lead to broader action.

You may use available controls to stop sharing, regenerate links, delete your content, hide, block, report, or delete your account. These actions cannot remove outside copies or records we may lawfully retain. Account deletion is available in the App, at yumeship.app/delete.html, or through support@worldbuilders.app.

8. Acceptable Use

You agree not to use Yumeship to create, store, export, or share content that:

You also agree not to bypass sharing controls, access a profile after you have been blocked or removed, evade a Shippers restriction or ban, create or use another account for evasion, help another person evade an enforcement action, scrape shared profiles, automate comments or reports, or use another user's shared content outside Yumeship without permission.

9. Notifications

Yumeship may let you schedule private notifications, reminders, or F/O-style notes. You are responsible for the notification text you create or approve. Do not use notification features to harass, threaten, manipulate, or encourage harm to yourself or others. You can manage notification permissions through your device settings.

10. Purchases, Subscriptions, and Refunds

Prices and terms are shown before purchase. Apple or Google processes payments, renewals, cancellations, and refunds under its rules; RevenueCat and our systems may validate purchases and entitlements. Users under the age of majority need parent or guardian permission.

Pro unlocks the included features offered for that purchase but does not include every future feature, content pack, service, or add-on. We may change the App and charge separately for future offerings. Eligible purchases may be restored through the applicable store, subject to verification.

Pin Passes are account-bound consumable items that may activate a time-limited paid placement for one eligible new Shippers post. They have no cash value, are non-transferable, and do not guarantee publication, availability, views, engagement, popularity, moderation priority, or any other result. A pass is consumed only when the server activates the placement.

All placements remain subject to eligibility, moderation, account standing, availability, rate limits, and our policies. Unless we approve it in writing, a Pinned Post may not contain or direct users to third-party advertising, sponsorships, affiliate marketing, fundraising, sales, or other commercial promotions.

We may refuse, interrupt, label, limit, or remove a placement for policy, safety, legal, platform, technical, fraud, security, or operational reasons. A pass consumed before an interruption is not automatically replaced or refunded, including when the post or account violates our policies, except where law or store rules require otherwise. We may change or discontinue future paid features, subject to applicable law.

11. Third-Party Services

Yumeship may rely on third-party services for app stores, sign-in, payment validation, analytics, diagnostics, backup, hosting, image storage, sharing, and support. Those services may have their own terms and privacy practices.

Opening a pasted music link, saving an export to another app, sharing through your device share sheet, or using a third-party platform is governed by that third party's terms and privacy practices. We are not responsible for third-party services, links, app stores, fandom properties, media platforms, or device providers that we do not control.

12. Privacy

Your use of Yumeship is also governed by our Privacy Policy, which explains how information is collected, used, stored, and shared.

13. App Changes

We may update, change, suspend, or discontinue parts of the App over time. Some features may be experimental, limited, renamed, or changed before full release.

To the fullest extent permitted by law, we are not liable for a modification, suspension, discontinuation, loss of compatibility, or removal of a feature or content. You are responsible for keeping copies of content you want to preserve.

14. Termination

We may suspend or terminate access to the App if you violate these Terms, misuse the App, create safety risks, or use the App unlawfully.

For account, Picshare, Moots, Shippers, F/O-space, or comment features, we may also remove content, limit features, disable sharing, remove access, preserve moderation records, or suspend an account if needed to enforce these Terms, protect users, or operate the service safely. The Shippers-specific access and banning terms in Section 7 apply even when we do not terminate access to the rest of the App.

You may stop using the App at any time.

Sections that by their nature should survive termination will survive, including ownership and licenses, retained records, disclaimers, limitations of liability, indemnification, releases, dispute terms, and general provisions.

15. Disclaimers

To the fullest extent permitted by law, Yumeship is provided "as is" and "as available." Worldbuilders Inc. and its affiliates, officers, employees, licensors, and service providers disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from a course of dealing.

We do not promise any minimum level of quality or service and do not guarantee that the App will be uninterrupted, timely, error-free, secure, permanently available, or free from harmful components; that content will be preserved; or that moderation will identify or prevent every violation or harmful interaction.

We do not control, endorse, verify, or assume responsibility for content submitted by users, conduct by users, third-party services, external links, or transactions between users. User content may be inaccurate, misleading, offensive, objectionable, or unlawful.

Information available through Yumeship is provided for general informational purposes. Any reliance on it is at your own risk.

We have no obligation to pre-screen, continuously monitor, preserve, or review all content, accounts, interactions, or conduct. Any moderation, verification, or safety measure we choose to provide does not create a duty to detect, prevent, or remedy every issue.

Yumeship is a creative tool. We do not guarantee any emotional, social, creative, therapeutic, or relationship outcome from using the App.

We do not guarantee any minimum distribution, audience, visibility, engagement, or other result from a Pinned Post. Feed position and paid-placement availability remain subject to Section 10.

16. Limitation of Liability

To the fullest extent permitted by law, Worldbuilders Inc. and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses involving data, profits, revenue, goodwill, opportunities, purchase or subscription issues handled by Apple or Google, or access to the App, arising from or relating to Yumeship or these Terms, even if advised that such damages are possible.

To the fullest extent permitted by law, these exclusions apply under every theory of liability, even if a remedy fails of its essential purpose. Their total aggregate liability for all claims arising from or relating to Yumeship or these Terms will not exceed the greater of US $100 or the amount you paid for Yumeship services during the three months before you first asserted the claim.

This limitation is a maximum cap, not liquidated damages or a promise of payment. A claimant must still establish liability and legally recoverable damages.

Worldbuilders Inc. is not responsible or liable for the content or conduct, online or offline, of any user or third party, or for disputes between users or with third-party services. You release Worldbuilders Inc. and the other protected parties above from claims arising solely from that content, conduct, or those disputes, subject to rights that cannot lawfully be waived.

These exclusions and limits do not apply where prohibited by law. Some jurisdictions provide non-waivable consumer rights or do not allow certain warranty or damages exclusions, so parts of this section may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Worldbuilders Inc. and its parents, affiliates, successors, assigns, officers, directors, employees, agents, licensors, service providers, contractors, advertising agencies, and distributors from third-party claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable legal and accounting fees, arising from or relating to your access to or use of Yumeship or a third-party service through it; Your Content or our authorized use of it; activity under your account; your violation of these Terms, another applicable policy, law, or another person’s rights; or your negligence or willful misconduct. This does not apply to the extent a claim results from our own unlawful conduct and does not limit non-waivable consumer rights.

We may assume exclusive control of the defense and settlement of a matter subject to indemnification, and you agree to cooperate reasonably with that defense. You may not settle such a matter in a way that imposes liability, an admission, or an obligation on an indemnified party without our written consent.

To the fullest extent permitted by law, you release the parties listed above from claims for compensation, attribution, inspection, approval, privacy, publicity, or moral rights arising solely from their authorized exercise of the licenses you grant in Section 3. This release does not cover a use outside those licenses or liability that cannot lawfully be released.

18. Dispute Resolution, Arbitration, and Governing Law

Before starting arbitration or a court case, the claimant must email an individual Notice of Dispute to support@worldbuilders.app that identifies the claimant and relevant account, describes the facts and claims, and states the requested relief. The parties will negotiate in good faith for 60 days after receipt and participate personally in a reasonable telephone or video conference if requested. This process is a condition precedent to formal proceedings; a court may decide whether it was satisfied, and applicable filing deadlines are tolled during it to the extent permitted by law.

For U.S. residents, an unresolved dispute will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, for coordinated filings, its Mass Arbitration Supplementary Rules. The Federal Arbitration Act governs. The arbitrator may award any individual relief available in court and decides the dispute and the scope or enforceability of this arbitration agreement, except that a court decides the enforceability of the class-action waiver and compliance with the informal process. Fees are governed by the AAA rules, and a hearing will ordinarily occur by telephone or video or, if in person, in the county where you live.

Either party may bring an eligible individual claim in small-claims court or seek temporary or injunctive relief in court to protect intellectual property, confidential information, safety, or service security. This section does not prevent a complaint to a government agency or apply where arbitration is prohibited by law.

TO THE FULLEST EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION. AN ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL CLAIMANT AND ONLY AS NEEDED TO RESOLVE THAT CLAIM. WHERE A DISPUTE PROCEEDS IN COURT, BOTH PARTIES WAIVE A JURY TRIAL. Coordinated arbitration demands remain individual and will be administered under the AAA’s applicable mass-filing rules; this does not authorize class arbitration.

You may opt out of arbitration, but not the other provisions of these Terms, by emailing support@worldbuilders.app within 30 days after first accepting this version, using the subject "Arbitration opt-out" and providing your name, account email or username, and an unequivocal statement that you opt out. If you validly opt out, neither party will be bound to arbitrate.

These Terms and all disputes are governed by the Federal Arbitration Act, applicable U.S. federal law, and Delaware law, without regard to conflict-of-law principles. Non-arbitrable disputes must be brought exclusively in a state or federal court located in New Castle County, Delaware, and the parties consent to personal jurisdiction and venue there. Unless applicable law requires longer, a claim must be filed within one year after it accrued or it is permanently barred. Non-waivable consumer rights, local forums, and longer limitations periods remain available where required by law.

19. Severability

If any part of these Terms is found unenforceable, it will be modified or removed only to the minimum extent necessary, and the remaining parts will remain in effect to the fullest extent allowed by law.

20. General Terms

These Terms, the Privacy Policy, the Community Guidelines, and any feature-specific terms presented to you form the entire agreement between you and us about Yumeship and replace prior agreements on that subject. Feature-specific terms control only for that feature if they conflict with these Terms.

You may not assign or transfer these Terms, an account, or rights under these Terms without our written consent. We may assign or transfer our rights and obligations, in whole or in part, without restriction or further notice, including in connection with an affiliate, financing, merger, acquisition, reorganization, sale of assets, or operation of law.

A failure or delay in enforcing a provision is not a waiver. These Terms do not create an agency, employment, partnership, joint venture, fiduciary, or franchise relationship. Headings are for convenience only, and "including" means "including without limitation."

We are not responsible for delay, interruption, or failure caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or utility failures, cyberattacks, provider or app-store outages, government action, epidemics, or changes in law or platform requirements.

21. Changes to These Terms

We may update these Terms to reflect changes to Yumeship or our business, comply with law, prevent abuse, or better protect users or the service. We will post the updated version and provide reasonable advance or additional notice when required; urgent safety, security, or legal changes may take effect sooner. If a change materially affects Shippers access, enforcement, paid access, dispute rights, or our rights to use shared or social content, we will require you to accept the updated Terms before continuing to use affected online features.
